Gov. Pritzker highlights SB3222 during ceremonial bill signing in Chicago

Illinois Gov. JB Pritzker on Thursday ceremonially signed Senate Bill 3222 during an event at SWAY Cannabis Dispensary in Chicago, where administration officials and lawmakers highlighted the measure’s changes to Illinois cannabis and hemp law.

According to the governor’s office, the legislation is intended to strengthen oversight of Illinois’ cannabis market while expanding access for medical cannabis patients and advancing social equity initiatives. Officials repeatedly emphasized new regulations for cannabis products that qualify as hemp under federal and state law, arguing that many had been sold outside Illinois’ licensed cannabis system without the safeguards required of products sold through state-licensed dispensaries.

In announcing the measure, Pritzker said the law strengthens protections for children, expands patient access, advances social equity, and improves the efficiency of the state’s regulatory system. He argued that parents should not have to worry about intoxicating THC products being packaged to resemble candy or other consumer products marketed toward children, and said consumers should be able to expect accurate labeling and product testing.

The governor’s office said the law immediately prohibits the sale of intoxicating hemp products to anyone under 21 years old. Beginning in November, those products will become subject to many of the same requirements that apply to Illinois’ regulated cannabis market, including child-resistant packaging, restrictions on marketing that appeals to children, and other provisions of the Cannabis Regulation and Tax Act.

SB3222 also makes broad changes to Illinois cannabis law beyond hemp regulation. Among its provisions, the legislation increases adult-use cannabis possession limits, expands eligibility for certain cannabis-related expungements, allows adult-use dispensaries to obtain medical cannabis licenses, permits curbside and drive-through pickup, expands telehealth certifications for medical cannabis patients, and enacts numerous regulatory changes affecting licensed cannabis businesses.

The governor’s office also highlighted provisions intended to reduce barriers for medical cannabis patients, expand hardship waivers and other assistance for social equity licensees, and streamline regulatory coordination among state agencies. Patient advocates Jim and Sandy Champion welcomed the expansion of medical cannabis access, saying they looked forward to registered patients being able to use every Illinois dispensary while continuing to receive the medical cannabis tax rate.

SB3222 was passed by the Illinois General Assembly earlier this year and signed into law by Gov. Pritzker in June. The legislation represents one of the most significant updates to Illinois cannabis law since adult-use legalization took effect in 2020.
