Cannabis is legal in Illinois, but home cultivation remains limited.

Illinois law allows registered medical cannabis patients who are 21 or older to cultivate up to five cannabis plants more than five inches tall per household, subject to additional requirements.

Cannabis Seeds

Illinois law allows registered medical cannabis patients to purchase cannabis seeds from licensed dispensaries for home cultivation.

Questions have persisted, however, about whether those seeds are actually available through Illinois’ regulated cannabis market. State officials recently confirmed to me that Illinois’ current seed-to-sale tracking system is capable of tracking cannabis seeds through the supply chain to retail sale.

Possession of Homegrown Cannabis

How much cannabis can a medical cannabis patient legally possess after harvesting their plants?

Illinois officials have confirmed that cannabis legally produced through medical home grow is treated differently from cannabis purchased by a patient. Patients can keep the cannabis produced by their legal home grow, although amounts exceeding the applicable possession limit must remain secured at the residence or residential property where the cannabis was grown.

Outdoor and Greenhouse Cultivation

Illinois requires medical home grow to occur within an “enclosed, locked space,” but that does not necessarily mean cultivation has to take place inside a house.

State materials and Illinois law contemplate cultivation in certain secured outdoor structures, including greenhouses.

Meanwhile, outdoor cultivation has become a broader issue within Illinois’ regulated cannabis industry. Some licensed commercial cultivators have already grown cannabis outdoors in secured screenhouses, and the state is now considering rules that would more broadly address outdoor cultivation by licensed growers.
