Illinois State Website Updated to Acknowledge Legalization of Cannabis Gifting

In a recent update to the official Illinois state website, the Illinois Cannabis Regulation Oversight Office (CROO) fulfilled its promise to provide clarity on cannabis gifting.

In case you missed it, my attention was drawn to this issue following a recent examination of the Illinois Cannabis Regulation Oversight Office website, where I noticed the absence of any mention of gifting cannabis in their FAQ section. This struck me as significant because, historically, official Illinois Government websites have featured various references to cannabis regulations, including explicit statements affirming the legality of gifting.

I am appreciative of CROO’s commitment to transparency and public awareness on these subjects. This commitment underscores the state’s dedication to fostering a well-informed community. With the official update to the state’s website, residents can now access accurate information to navigate the state’s cannabis regulations responsibly.

Below is the email correspondence that I received from the state earlier this morning.

Hey Cole,

Just letting you know the gift question is (finally) live on our website.  Thanks again for asking the question!

Have a great weekend,

Nate

Question about Possession Limit for Medical Cannabis Patients

As noted in my last article on this subject, in response to Nate’s email, I posed the following question:

Can you also let me know what the possession limit for registered medical cannabis patients is? Do medical cannabis patients have a possession limit at home? For example, if a medical patient cultivates cannabis at home, do they need to dispose of quantities that exceed their possession limit? Or do they simply need to ensure that those quantities are “secured in the home”?

This is a copy of my email to the state of Illinois. Email sent on April 18, 2024.

Since my question was appended to the email that was sent on April 18, I worry that Nate might have missed the question in the thread.

To make sure that my question is seen, I’ve sent a separate message regarding the matter. Below is the copy of my communication with the State.

Thank you Nate, I’ll check it out! I appreciate you and the departments willingness to help out. To confirm, did you see my (unrelated) follow up question? I pasted it below for your reference.

Unrelated to this but I’ve been looking for direct guidance from state: Can you also let me know what the possession limit for registered medical cannabis patients is? Do medical cannabis patients have a possession limit at home? For example, if a medical patient cultivates cannabis at home, do they need to dispose of quantities that exceed their possession limit? Or do they simply need to ensure that those quantities are “secured in the home”?

Thanks,

Cole

I will post any updates that I receive from the state on this information. I look forward to continuing to work with the state to provide answers to these straightforward questions so that the community can be sure to remain in accordance with the many laws and criminal penalties that remain in effect in Illinois.

Update: the state responded to my follow up question regarding possession limits. You can read the response here.
